A binding contract for the supply of materials is formed only when we issue a written confirmation of order. We reserve the right to decline or withdraw a quote, or to require revised terms, where there is a material change in cost, availability or specification.
5. Pricing, payment and taxes
Prices are quoted exclusive of VAT and any other applicable taxes or duties unless otherwise stated. Payment terms will be set out in our order confirmation or invoice. Unless otherwise agreed in writing, all invoices are payable in full by the date stated, in pounds sterling (GBP).
We reserve the right to charge statutory interest and reasonable recovery costs on overdue invoices in accordance with applicable UK legislation.
6. Delivery and risk
Delivery dates and lead times are estimates given in good faith and may vary due to shipping schedules, import procedures, supplier availability and other factors outside our reasonable control.
Unless otherwise agreed in writing, risk in the materials passes to you on delivery to the agreed address. Title in the materials remains with us until we have received full payment in cleared funds.
7. Inspection and acceptance
You should inspect materials on delivery and notify us in writing of any visible damage, shortage or discrepancy within a reasonable period after delivery. Failure to notify us within a reasonable period may affect our ability to resolve the issue.
8. Specifications and technical information
Where mill certificates, datasheets or other technical documentation are required, please request these at the time of enquiry. Photographs, illustrations and descriptions on this website are provided for general information only and are not a substitute for the formal specification confirmed in writing for your order.
9. Cancellations and changes
Once an order has been confirmed, cancellations or changes may not be possible, particularly where materials have been sourced or shipped specifically for your order. Any agreed cancellation may be subject to charges to cover costs already incurred.
10. Limitation of liability
Nothing in these Terms limits or excludes our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be limited or excluded by law.
Subject to the paragraph above, our total liability to you arising out of or in connection with an order shall not exceed the price paid by you for the materials giving rise to the claim. We will not be liable for any indirect or consequential loss, loss of profit, loss of contract, loss of business opportunity or loss of goodwill.
11. Force majeure
We will not be liable for any delay or failure to perform our obligations where the delay or failure results from events outside our reasonable control, including (without limitation) shipping delays, port disruption, customs or border issues, supplier failure, industrial action, severe weather, fire, flood or government action.
